Programme on Cultural Co-operation between the Ministry of Culture of the Republic of Estonia and the Ministry of Culture and Tourism of Ukraine for the period of 2005-2008
Programme on Cultural Co-operation between the Ministry of Culture of the Republic of Estonia and the Ministry of Culture and Tourism of Ukraine for the period of 2005-2008

The Ministry of Culture of the Republic of Estonia and the Ministry of Culture and Tourism of Ukraine, hereinafter referred to as "the Parties", in accordance with the Agreement between the Ministry of Culture of the Republic of Estonia and the Ministry of Culture and Arts of Ukraine on Cultural Co-operation signed on 1 April 1996; desiring to develop co-operation in the sphere of culture and art; promoting common cultural rapprochement, development of creative potential, acquaintance with cultures of both states; have agreed as follows:

ARTICLE 1

The Parties shall encourage co-operation and direct contacts between musical, theatrical and other establishments of culture, creative associations, art and culture workers, as well as participation of representatives of two states at the international competitions, festivals, conferences, symposia and seminars.

ARTICLE 2

The Parties shall facilitate the participation of Ukrainian and Estonian theatres in international theatrical festivals to be held both in Ukraine and the Republic of Estonia. The Estonian Party suggests the Ukrainian Party to take part in:

International theatre festival "Baltoscandal" (June, one time in two years, Rakvere); bInternational theatre festival "Midwinter Night Dream" (December, annually, Tallinn).

The Ukrainian Party suggests the Estonian Party to take part in:

Festival "Slavic theatre meetings" (March-April, Chernigiv, annually);

Festival "Ternopil theatre evenings. Debut" (September, Ternopil, annually);

Festival of puppet-shows "Interlyalka" (October, Uzhgorod, one time in two years); the International drama festival "Zoloty Lev" ("Golden Lion") (Lviv, one time in two years).

ARTICLE 3

The Parties shall develop co-operation in the field of a library matters, to encourage direct links between libraries, particularly between National Library of Estoniaand National Library of Ukraine after V. Vernadsky, exchanges of experts and researcherswith the purpose of participation in scientific conferences, symposia and seminars on library matters, exchange of experience. In this regard the Parties annually exchange 2 experts. During the validity of this Programmethe Parties shall exchange books exhibitions: Estonian - in Ukraine and Ukrainian - in Estonia.

ARTICLE 4

The Parties shall continue their co-operation in the field of preservation and restoration of historical and cultural monuments, maintain co-operation in the field of art history and museology.

ARTICLE 5

The Parties shall facilitate the exchange of opera and ballet artists, stage- directors and conductors, as well as the participation of professional art groups in festivals to be held in both states. In particular, the Parties shall facilitate the participation in: Neeme Järvi Summer Academy for orchestra conductors (July, Pärnu, annually); Nyyd-festival of contemporary music (November, Tallinn, one time in two years); International Ivan Kozlovsky competition of vocalists (March – April, Kyiv, one time in two years); International festival Kyiv-music-fest (September-October, Kyiv, annually).

ARTICLE 6

Parties shall fosterexchange of exhibitions of modern art, as well as exhibitions of decorative,applied and folk art. The terms of exchanges shall be determined case by case by the separate protocols between direct organizers of exhibitions.

ARTICLE 7

The Parties shall foster the participation of delegations of Ukraine and the Republic of Estonia in international film festivals and film weeks to be held in both states on a mutual basis.

The Estonian Party invites the Ukrainian Party to participate in the International cinema festival "Black nights" (November-December, Tallinn, annually).

The Ukrainian Party suggests the Estonian Party to take part in the International cinema festival "Molodist" ("Youth") (October 25 – November 1, Kyiv, annually) and the International festival of tourist films "Viter mandriv" ("Wind of travelling") (September-October, Kyiv, annually).

The Parties shall also facilitate: direct co-operation between cinematographic institutions, film-producers, organisations and unions of cinema producers, cinema archives of both states; film exchange on a commercial and non-commercial basis; the participation of films and their authors, as well as experts in international and national film festivals to be held in both states in accordance with statutes of these festivals.

During the Programme in force the Parties shall explore the possibility of films co-production.

ARTICLE 8

The Parties shall encourage development of direct co-operation between culture and art educational establishments of both states. Financial terms of co-operation shall be established directly by interested organizations.

ARTICLE 9

The Parties are interested in the development of direct co-operation between cultural and art institutions, museums, art schools, art unions and associations on the level of regions of the Parties’ states. The content, forms and methods of financing that sort of co-operation shall be defined on the basis of direct agreements between interested organizations.

ARTICLE 10

The Parties shall take, within their competence and in accordance with rules of international law and legislation in force of the Parties’ states, measures to prevent illegal import and export of cultural values, shall exchange the relevant information on these issues and groups of experts.

ARTICLE 11

The Parties shall carry out exchanges of delegations of culture and art establishments of it’s states, as well as information materials on culture subjects with the purpose of experience exchange and co-operation deepening.

ARTICLE 12

The Parties shall support activitiesof cultural societies of the Estonians living in Ukraina and the Ukrainians living in Estonia.

ARTICLE 13

The Parties under the mutual agreement could organize and carry out other cultural actions that correspond to the aims of this Programme.

ARTICLE 14

The cultural exchanges between the Parties shall be carried out on such terms:

1. Exchange of delegations.

The sending Party shall cover expenses connected with travelling to and from place of the invitation, except separate cases to be stipulated in a separate agreement.

The receiving Party shall cover costs connected with board and lodging, transport services in it’s territory, providing services of translator according to the programme of stay.

2. Terms of financing exchange of art groups, museum exhibitions and exhibitions of modern art shall be determined additionally in separate protocols concluded between direct organizers of actions.

ARTICLE 15

This Programme may be amended or supplemented.

Amendments and supplements to this Programme shall be drawn up as separate protocols, which shall enter into force on the date of signature by both Parties and constitute an integral part of this Programme.

The implementation of this Programme shall be carried out within the framework of the legislation in force of the Parties’ states.

ARTICLE 16

The Parties through negotiations and consultations shall settle all disputes about the interpretation or implementation of this Programme.

ARTICLE 17

This Programme shall enter into force from the date of its signature and shall remain in force until 31 December 2008 or until a new programme is signed.

Done at______________ on "__"_____________ 2005 in duplicate in the Estonian, Ukrainian and English languages, all texts being equally authentic. In case of any divergence in the interpretation, the English text shall prevail.
